Do I need works council consent for a pension scheme?
Introducing or amending a second-pillar pension scheme is in principle subject to works council consent under article 27 of the Wet op de ondernemingsraden. In a Wtp transition that process forms part of your transitieplan and takes time; work backwards from 1 October 2027 in your planning.
If you offer a third-pillar arrangement such as the werkgeverslijfrente, the position is more nuanced: it does not fall under the Pensioenwet. Whether consent is required depends on how you embed the scheme in employment terms. Put this to your lawyer or pension adviser before introducing it. If you have no works council, the rules on employee representation or individual consent apply.
